  • Position Overview:
  • Manages the City's Licensing Section, including staff leadership; oversees changes to business and lottery licensing legislation; issuance and revocation of business and lottery licenses and laying of charges against individuals/businesses; fulfills legislated responsibilities as the City's Lottery Licensing Officer; and performs municipal electoral responsibilities as assigned by the City Clerk

  • Leadership & Administration
  • Directly supervises the work of 1 Business Licensing Inspector and 3 Licensing Officers, with responsibility for interviewing and selection, orientation and training, direction and guidance, and performance management up to and including recommending termination.
  • Reviews, analyzes, and prepares new and existing Licensing Bylaws in conjunction with Legal Services staff and Business Licensing Inspector, based on new legislation, complaints, and Council direction.
  • Researches Bylaw amendments, new policies, tribunals through other municipalities, Alcohol & Gaming Commission of Ontario (AGCO), Legal Services staff, police, notes, Municipal Act, and Bylaws. Writes reports, correspondence, and recommendations on licensing matters for consideration by management and Council.
  • Reviews and approves information to be included on licensing forms and related correspondence as prepared by Licensing staff.
  • Reviews, analyzes, and prepares License Fees (based on costrecovery); presents and recommends to Council.
  • Perform duties of Lottery Licensing Officer as set out in Provincial regulations in order to ensure all AGCO rules and regulations are enforced. Oversees charges to be laid and supervision of licenses issued. Recommends new policies to Council.
  • Reviews and analyses Provincial regulations related to specific situations as they arise in order to enforce legislation. Makes recommendations/comments to the Province for revisions to legislation on behalf of the City, in conjunction with the Director, Legislated Services/City Clerk.
  • Prepares and oversees Operating Budget
  • Ensures that payments/deposits are made in accordance with set procedures; ensures that checks and balances are in place for procedures.
  • Investigations & Charges:
  • Provides advice, direction, and approval to the Business Licensing Inspector regarding charges to be laid against businesses in violation of licensing regulations, resulting in Court action.
  • Acts as a witness to provide evidence in court regarding lawsuits.
  • Following court action, if business continues to be in violation, undertakes further action (e.g., closure) until compliance is achieved.
  • Consults with Legal Services staff, evaluates, and recommends to Council appropriate conditions on licenses (e.g., hours of operation) to be imposed in order to ensure compliance and/or curtail illegal activity.
  • In conjunction with Director, Legislated Services/City Clerk, determines when it is necessary to forward Licensing matters to a Committee of Council for a hearing and provides background information and all relevant evidence; if required, provides testimony at Licensing Hearings.
  • Assists with affidavits and evidence gathering for litigation against the City in Licensing matters.
  • Consults with staff in order to determine the type of remedial action required to avoid prosecutions for those in violation of Lottery regulations.
  • Evaluates and recommends to the AGCO situations warranting formal investigation related to a charity's lottery activities.
  • Reviews, evaluates, and provides advice and recommendations to Council on changing business environments (e.g., state of industry, business practices, viability, new Bylaws). Performs other related duties as required.
  • Requirements:
  • 3-year degree or diploma in a related field.
  • 47 years of related experience including legislative and policy enforcement and advising as it relates to business and lottery licensing,
  • Experience with and knowledge of lotteries, enforcement procedures, business and lottery licensing, and accounting procedures.
  • Knowledge of fee structures and the ability to adjust fees accordingly (based on cost recovery).
