POSITION PURPOSE
Reporting to the Supervisor, Prosecutors, is responsible for conducting prosecutions under Federal and Provincial statutes and regulations and municipal by-laws in the Ontario Court of Justice; providing guidance, training, mentoring, and coordinating, assigning, scheduling and checking the work of assigned Prosecutors and ensuring a safe working environment.
MAJOR RESPONSIBILITIES
- Conducts prosecutions under Provincial statutes and regulations and Municipal bylaws in the Ontario Court of Justice.
- Appears as respondent or appellant in the Ontario Court of Justice on matters relating to appeals under the Provincial Offences Act.
- Conducts prosecutions of Federal offences under the Contraventions Act (Canada).
- Responds to customer enquiries directly and/or resolves difficult or highly sensitive complaints either verbally or in writing.
- Liaises with, fosters and maintains positive relationships with internal staff and external contacts including the judiciary, solicitors, local municipalities, ministries, policing and enforcement agencies and the general public.
- Provides guidance, training, mentoring and coordinates, assigns, schedules and checks the work of assigned Prosecutors.
- Provides input on performance reviews for staff and provides feedback to the Senior Counsel, or Associate Counsel.
- Develops education strategies for various enforcement agencies and staff in conjunction with the Senior Counsel Prosecutions and the Associate Counsel Prosecutions.
QUALIFICATIONS
- Successful completion of a Secondary School diploma.
- Minimum of five (5) years experience in prosecuting and/or defending municipal and/or provincial offences in the Ontario Court of Justice or successful completion of a Court and Tribunal Agent Program or Paralegal Program and a minimum of three (3) years experience in prosecuting and/or defending municipal and/or provincial offences in the Ontario Court of Justice
- Must be licensed by the Law Society of Upper Canada to practice law or provide legal services as a Paralegal.
- Satisfactory Police Criminal Background Check.
- Knowledge of rules of evidence and Ontario Court of Justice trial and appeal procedures.
- Valid Ontario Class "G" driver's license and reliable vehicle for use on corporate business.
- Working knowledge of relevant Federal and Provincial statutes and regulations and municipal bylaws applicable to Provincial and Municipal offences and Charter of Rights and procedures relating to Charter issues.
- Knowledge of and demonstrated ability in corporate core competencies including customer service, communication, team work, initiative/self management, accountability, flexibility and adaptability.
