Job Description:


Accountabilities:

  • Draft and distribute notifications of legal claims to insurer; investigate legal claims to obtain and provide relevant evidence to insurance adjuster and outside counsel; gather and provide answers to requests for information from the insurance adjuster and outside counsel
  • Manage all actual and potential legal claims including but not limited to medical malpractice, slip and falls and Human Rights Tribunal claims, commercial claims and files; collaborate with outside counsel in defending lawsuits from inception to dismissal or settlement, with a focus on mitigating risk; assist outside counsel with coordinating witnesses for discoveries and/or trial
  • Maintain claims management database: input key information, claim details, summary description, parties involved, contact information, key dates, financial information, status, documents, and correspondence
  • Conduct investigative and/or support meetings/interviews with staff (witnesses) from all levels and areas of hospital, which includes all units/programs/departments, including third party contractors as needed
  • Participate in examination for discovery prep meetings and assist outside counsel with preparing witnesses for discoveries and/or trial
  • Review legal documentation, such as statements of claim, motions, notices, discovery transcripts and approve some legal documentations such as an affidavit of documents
  • Obtain approvals for settlement of legal claims and provide instructions re settlement to outside counsel
  • Document important dates (hearings), legislative requirements, setup and maintain filing systems, utilizing knowledge of legal records and procedures and frequently controlling confidential materials and documents; accept service of court documents; determine and establish office procedures and routines
  • Act as the key contact for accepting service of legal documents and facilitating service on staff; outside counsel and insurance partners (HIROC); handle inquiries and/or provide guidance regarding service of legal documents (summons, subpoena); handling police inquiries/request from either staff or police regarding the release of information; and for staff and liaison between staff/witnesses and outside counsel throughout litigation process
  • General office work as required

Qualifications:


  • Five or more years of work experience in a claims/risk management role, preferably in the hospital sector
  • Experience in claims reporting and document management
  • Experience in conducting legal research and internet searches
  • Advanced proficiency with office software including Microsoft Office (Outlook, Word, Excel and PowerPoint), Adobe and electronic data management systems such as Meditech, CanLII and Datix
  • Strong interpersonal skills and the ability to build harmonious working relationships within your immediate team, across other departments at the hospital, and with external legal counsel, insurers and adjusters
  • Possessing exceptional communication skills (both verbal and written)
  • Being adaptable to changing priorities in a fastpaced environment while being organized and maintaining accuracy with a high attention to detail
  • Demonstrating strong research, investigative and problem solving skills with the ability to exercise judgement to resolve issues
  • General understanding of relevant legislation including without limitation: Rule of Civil Procedures; Criminal Code; Police Services Act; Mental Health Act; Health Care Consent Act, Public Hospitals Act; Substitute Decision Makers Act; Coroner's Act, PHIPPA, FIPPA and similar legislation
