Alberta Teaching Profession Commission


The Education Act provides the statutory authority for the Alberta Teaching Profession Commission and the appointment of an arm's length Commissioner to oversee teacher and teacher leader conduct and competency complaints for the profession.

This process applies to all teacher and teacher leaders under the Education Act (the Act).


The Commission oversees a new model, which came into force on January 1, 2023, for teacher and teacher leader disciplinary matters that brings Alberta in line with best practices used in comparable provinces and other regulated professions.

The new Commission protects students and enhances accountability and transparency for disciplinary matters as a regulated profession.


Role:


Professional Assurance Manager


Reporting to the Director, Professional Assurance, this position is accountable for providing provincial expertise and specialized advice, consultation and support for professional discipline matters for all Alberta-certificated teachers and teacher leaders.

This position directly supervises Professional Assurance Officers (PS4) staff.


Representing the interests of the Commissioner, Alberta Teaching Profession, in addressing complaints of alleged unprofessional conduct and professional incompetence filed against Alberta certificated teachers and teacher leaders in accordance with the code of professional conduct for the teaching profession, and determining the appropriate course of action to take regarding complaints and the teacher or teacher leader's suitability to hold a teaching or leadership certificate in accordance with legislation.


The position helps ensure accountability in matters of professional discipline so Alberta has excellent teachers and teacher leaders in the early childhood to grade 12 education system.


The position provides leadership and assumes responsibility in ensuring complaints of alleged unprofessional conduct and professional incompetence filed against Alberta certificated teachers and teacher leaders are properly addressed using a legislated process established, to ensure the Commissioner's interests are appropriately considered and represented.

The
Professional Assurance Manager will be responsible for the following key activities in the ministry:

1. Analyzing allegations in complaints of alleged unprofessional conduct and professional incompetence for teachers and teacher leaders.


This includes conducting a risk analysis, developing the appropriate course of action upon receipt of a complaint and then again based on findings in an investigation report; and preparing draft decisions for the Director, Professional Assurance and Commissioner's consideration; and ensuring procedural fairness in accordance with the Education Act.


2. Prosecuting/presenting cases of alleged unprofessional conduct and/or professional incompetence involving teacher and teacher leaders to discipline committees (tribunals) to be heard.


This position is delegated responsibility by the Commissioner to represent the Commissioner in hearings and make decisions on behalf of the Commissioner during these proceedings under the Education Act (new model), and the Teaching Profession Act and Practice Review of Teachers and Teacher Leaders Regulation (for complaints that are transitioned to the Commissioner's Office under previous models), requiring the incumbent to have expertise in three different legislative structures to address complaints.

3. Providing leadership and support to a team of Professional Assurance Officers to ensure investigation reports submitted include all of the necessary information related to the allegations made in a complaint.


This includes building understanding of how the findings in an investigation report are interpreted using legislation and considered as evidence in a hearing/tribunal, using a quasi-judicial process.


4. Representing the Commissioner in legal depositions for cases of professional discipline involving Alberta certificated teachers and teacher leaders.
