The Municipality of Chatham-Kent has an opening for a permanent full-time Prosecutor, Provincial Offences Court of the Municipal Governance division.


Job description


The Prosecutor provides prosecutorial services for the Provincial Offences Court in accordance with the Memorandum of Understanding (MOU) Prosecutorial Standards as set out by the Province of Ontario and Professional Rules.

The Prosecutor is responsible for conducting Part I, Part II, and Part III prosecutions, appeals and early resolution meetings in the Ontario Court of Justice for offences under provincial statutes, selected federal statutes and municipal by-laws, and any matters delegated by the Attorney General.


Essential responsibilities

  • Demonstrate Chatham-Kent's core values and competencies
  • Prepare and conduct prosecutions of matters under Provincial Statutes, Municipal Bylaws and the Contraventions Act (Canada) in the Ontario Court of Justice, Provincial Offences commenced under Part I, Part II and Part III of the Act, and any matters delegated by the Attorney General.
  • Conduct and commence or respond to motions and appeals under the applicable legislation
  • Prepare and conduct Early Resolution Meetings
  • Prepare and conduct Pretrials
  • Review and manage all requests for disclosure utilizing CAMS
  • Maintain current knowledge of developments in all applicable legislation and the common law
  • Research relevant case law to prepare for cases
  • Liaise with law enforcement agencies, officials of other Ministries, the Crown Attorney's Office, the Judiciary and the general public, and maintain an excellent working relationship with all

Essential qualifications

  • College diploma or university degree in Paralegal program, with four (4) to six (6) years of related experience
  • Licenced Paralegal (member of law society of Upper Canada good standing)
  • Licenced Lawyer considered an asset
  • Significant and demonstrated courtroom experience related to Provincial Offences ; extensive knowledge of court procedures, rules of evidence and organizational understanding of the Justice System and Law Enforcement
  • Thorough knowledge of the Provincial Offences Act, Highway Traffic Act, Contravention's Act, Rules of Evidence, Charter of Rights and Freedoms, and related statutes and regulations
  • Strong computer skills, specifically Microsoft Office (Word, Excel, PowerPoint, Outlook) (or similar software program)
  • Ability to conduct legal research using electronic resources
  • Ability to interact with various stakeholders, including the legal profession, enforcement agencies, other government ministries and departments, and the general public
  • Excellent communication shills, verbal and written
  • All employees will be required to complete their Health & Safety and other online mandatory training on or before their first day of employment; other training (including Health & Safety policies) may also be required

Other qualifications

  • Proficiency in French, both oral and written, would be an asset
  • Prosecutorial experience would be an asset
  • Experience with CAMS and ICON would be an asset

Certifications, memberships, licenses:


  • Law Society of Ontario member in good standing

  • This position works indoors
  • This position works weekday hours

COVID-19 Vaccination
The Municipality of Chatham-Kent no longer requires a COVID-19 vaccination as a condition of employment. Although it is not mandatory to be vaccinated, it is highly encouraged.


Driver's licence/vehicle requirements


Because this position would be required to travel, a valid Province of Ontario driver's license with a reliable motor vehicle is necessary.

Essential physical and/or safety requirements

  • Walking: frequent walking on level surface (back and forth to courtroom)
  • Sitting: frequent sitting in a chair (role is predominantly sitting at a desk in the courtroom or in the office meeting with defendants)
  • Standing: frequent standing inside (stands in court to enter facts, joint submissions, and when addressing the Justice of the Peace)
