    Role Responsibilities

    Reporting to a Senior Adjudicator, the Adjudicator will work within a complex framework of legislation, including the Traffic Safety Act (TSA) and the Provincial Administrative Penalties Act (PAPA), case law and departmental policy and procedures. The Adjudicator will provide adjudication services to clients throughout the province who are seeking review of their notice of administrative penalty in relation to alcohol or drug-related driving contraventions.

    Under PAPA, the Adjudicator will conduct impartial reviews of Notices of Administrative Penalty (NAP) and will be expected to review oral and written submissions, weigh complex, and at times, conflicting evidence, and properly identify and apply relevant case law, policy, and technical materials. The Adjudicator will need to have exceptional communication skills to clearly communicate with citizens who have requested a review, explaining and managing the process to individuals in accurate but non-technical manner. The Adjudicator must be highly attentive and detail oriented to properly assess the submissions of all parties and able to provide precise written decisions quickly and comprehensively under strict timelines.

    The main responsibilities for the Adjudicator, Impaired include (but are not limited to):

  • Rendering decisions within legislated time limits in a clear, concise and well-reasoned manner
  • Analyzing information provided through the review process including detailed reports to determine appropriate action
  • Ensuring fair process in accordance with the principles of administrative law and natural justice
  • Drafting, editing and rendering decisions providing clear, logical, well-written, detailed and cogent reasons for findings in accordance with current law and program standards
  • Conducting oral and written reviews of Immediate Roadside Sanction NAPs (as designated by the Director of SafeRoads Alberta), controls proceedings and deals effectively with emotionally - charged individuals while focusing on fair outcomes
  • Hear applications for relief from third-party affected persons vehicle seizures and applications for review of suspended driver vehicle seizures (as delegated by the Registrar of Motor Vehicles)
  • Participating in program meetings to harmonize standards, criteria and interpretations applied to various issues
  • Making recommendations to improve program effectiveness
  • Assisting with program data collection and reporting
  • Qualifications

    Required:

  • A University degree in a related field (i.e. Public Administration, Public Policy, Law, Business Administration, Criminal Justice or related discipline) supplemented by 4 years progressive experience in the following areas:

  • Making findings of fact
  • Interpreting and applying legislation and policy in complex situations
  • Writing briefings that include setting out options and making recommendations
  • Exceptional communication skills such as interviewing, written and oral, and active listening skills

  • Judgement and decision making skills
  • Conflict resolution, negotiation and mediation
  • Sensitivity to confidentiality, respect and ethical behavior

  • Interpretation and understanding of legislation including the Traffic Safety Act and its regulations, the Provincial Administrative Penalties Act (PAPA) and its regulations and the Criminal Code (Canada)
  • Computer skills including information management systems and Office 365.
  • Equivalency: Directly related education or experience may be considered on the basis of:

  • 1 year of education for 1 year of experience; or
  • 1 year of experience for 1 year of education.
  • Desired:

  • Previous experience with SafeRoads adjudication or other tribunals
  • Strong conflict resolution, negotiation, and mediation skills
  • Experience writing formal adjudication decisions

    The positions are full time roles with the standard weekly work hours of 36.25, Monday to Friday (8:15 am - 4:30 pm).

    SafeRoads Alberta participates in the Work from Home Hybrid – Please note though that this position would be eligible to participate in the Work from Home Hybrid once the incumbent is fully on-boarded, trained, fully designated by the Director of SafeRoads Alberta and performing satisfactorily in the role.

    This competition will be used to fill current and future vacancies at the Program Services 4 Market Adjustment classifications for temporary and permanent positions within the SafeRoads Alberta Branch.
