About the Role


Reporting functionally to the Commercial Director and operationally to the Project Manager / Operation Manager / General Manager / District Manager, the Commercial Manager is responsible for managing all contractual and commercial aspects of an assigned Business Unit including providing contractual, procurement, project control, risk and opportunity, and commercial management support to pre-construction and project teams, including the mentoring of commercial specialists and other project team personnel.


As Commercial Manager for Graham you will:

  • Review bid documentation to identify risks and opportunities to be considered within the bid and the overall compliance of tender documentation with Graham's standard contracting principles.
  • Ensure that the Risk Management Plan is completed for all pursuits, including the development of risk mitigation strategies, and ensure that the proposed bid has considered all the identified risk mitigation strategies.
  • Liaise with Graham areas of expertise, Insurance and Legal Departments, to receive their expert input with respect to the bid document review, Risk Management Plan, performance security and insurance requirements.
  • Assist in the preparation of bespoke or modified Designer Teaming Agreements, Design Services Agreements, and Professional Services Teaming Agreements as required, and obtain the necessary approvals required prior to the finalization of such agreements.
  • Assist in the preparation of other agreements including Integrated and Non-Integrated Joint Venture Agreements, as required.
  • Collaborate with Pre-Construction team members in developing the tender budget.
  • Participate in any posttender precontract negotiations.
  • Review contract documents prepared for execution for awarded projects to ensure compliance with the bid submitted, ensuring prior to document execution any deviations is drawn to the authorised signatories attention.
  • Manage the project's commercial, contractual administration and financial operations, and mentor and support the project team throughout the project lifecycle.
  • Provide input into the project specific organizational and responsibility matrix to ensure proper project planning, scheduling, staffing, cost control, and project management.
  • Understand Graham's contractual obligations and ensure that Graham remains compliant, including with all notice provisions. Where notices are required to be issued take the lead in the preparation of all contractual notices.
  • Liaise with Legal and Insurance Departments on contractual and insurance matters.
  • Review in detail projects cashflow, revenue, cost, profit & loss, and risk & opportunity positions, both actual to date and projected.
  • Provide required input into internal and external progress reports.
  • Ensure compliance with company standards and procedures and deliver commercial training and mentoring to the project team as required.
  • Support the project teams with the preparation, drafting and negotiation of all subcontracts and approve final versions prior to signature.
  • Support the project team with the preparation, negotiation, and approval of all Prime Contract and subtrade change order requests, ensuring that change order request tracking is up to date and complete, and that the schedule impact of the changes has been fully considered.
  • With respect to contractual claims and the defense of contractual claims, support the project team to establishment a claims strategy, including record keeping, preparation and settlement negotiation.
  • Provide any other contractual and commercial support and direction to the project teams as required.
  • Establish and maintain relationships with public and private sector clients, construction jointventure partners, financing partners, and key specialist subcontractors.
  • Build effective relationships with customers, design team, subcontractors, suppliers, and user groups that reflect and support Graham core values.

Qualifications/Experience:


  • Degree in Construction Management, Engineering, Quantity Surveying, Business, or a related field.
  • 10 years of construction and commercial management experience working on large ($100M) construction projects, including stewar
