OBJECTIVE


The Customs & Trade Compliance Specialist (CTCS) is responsible for providing regulatory compliance guidance for the import and export of raw materials and finished goods traded by Mustang.


The CTCS develops, implements, manages and maintains overall customs compliance procedures to ensure Mustang is compliant with all aspects of importing and exporting regulations including Canada and U.S.

Customs, as well as other various agencies, laws and regulations.

The CTCS will act as the first point of contact for daily interactions with brokers and customs officials to ensure timely clearance through Customs.


This position will also oversee the Customs Compliance Standard Operating Procedure (SOP) and provide guidance and recommendations to enhance Mustang's ongoing compliance efforts.

This will include developing and implementing an internal Customs Compliance Audit Program, (including conducting risk assessments and monitoring of brokers, third party agents and suppliers) and work with Mustang operations, brokers and auditors to address identified issues.

The CTCS will work with purchasing, customer experience, logistics and order fulfillment in a team-oriented and consultative manner as well as representing the company to external partners, Customs Agencies and customers as required.


STRUCTURE
The Customs & Trade Compliance Specialist, reports directly to the Director, Global Sourcing & Supply Chain. This position works closely with Purchasing, Customer Experience, Logistics and Order Fulfillment. This position has no direct reports.


KEY RESULT AREAS

Key Result #- Regulatory Compliance (40%)

  • Develop and coordinate the implementation of internal policies and procedures designed to comply with Canadian, US and foreign import/export regulations (i.e. classifications, valuation, quantity, origin and trade agreements); and recommend changes to import/export compliance policies based upon regulatory developments.
  • Responds to Government Agencies' Requests for Information and Notice of Action (i.e. CF 28, CF 29).
  • Continuously monitor governmental and industry developments (i.e. customs compliance, HTS, USMCA/CUSMA) and maintain current information on all import/export regulations.
  • Ensure Reasonable Care as set out in the Tariff Act.
  • Maintain an accurate tariff classification database within NetSuite, including raw materials and finished goods for current and pending products.
  • Provide customer service and support to both internal and external customers through the entire supply chain to resolve a full variety of time sensitive Customs related issues.
  • Prepare and maintain US and Canadian Customs Rulings for Mustang products.
  • To organize and coordinate a compliance evaluation to review recordkeeping, classifications, valuations, special duty programs and all other aspects of a company's compliance activities relative to current requirements. The CTCS will then recommend improvements and redesign processes and procedures resulting in less postentry activity and lower risk of penalties.
  • To develop and maintain ongoing SOP's and a centralized Customs and Trade Compliance Manual.

Key Result #- Import & Export Documentation and Freight Movement (40%)

  • Work with forwarders and/or Logistics to ensure timely, compliant, and costefficient delivery of raw materials and finished goods (import and export).
  • Review import and export documentation for brokers, freight forwarders and customers as required.
  • Review B3 and CF7501's on a daily basis to ensure accuracy and coordinate changes as required.
  • Work closely with suppliers and vendors to ensure the most accurate and uptodate classification.
  • Manage USMCA/CUSMA compliance program for Mustang's Canadian and US operations to reduce duties payable.
  • Utilize government programs such as Canadian Goods Returning and US Goods Returning to minimize financial exposure on intercompany transfers.
  • Identify opportunities for duty refunds and savings including trade agreements, duty drawback and remission orders.
  • Work with the accounting department to ensure accurate GL coding for brokerage and duty charges.
