The Ministry of the Attorney General (MAG), Criminal Law Division is in need of (2) counsel for the Crown Law Office - Criminal (CLOC)'s "Wagg & Freedom of Information (FOI) Unit".

The Ministry is responsible for screening records from police investigative files and Crown briefs for use in collateral regulatory and civil proceedings, pursuant to the Ontario Court of Appeal's decision in _D.P.

v. Wagg, [2004] O.J. No.

2745._ The Ministry also responds to requests submitted under the_Freedom of Information and Protection of Privacy Act_ (FIPPA) and alleged privacy breaches in relation to the Criminal Law Division.

CLOC's Wagg & FOI Unit discharges these responsibilities.

What can I expect to do in this role?: Duties will include:

  • Collaborating with and supporting the unit's counsel, law clerks, and administrative staff
  • Liaising with staff in the Ministry's Civil Law Division Wagg Unit, and providing instructions on files to their counsel and clerks, as well as counsel and staff in local Crown Attorney's offices, sometimes on an urgent basis, at both interim and final stages
  • Overseeing file intake, deadlines for instructions and the production of records in accordance with instructions and/or court orders
  • Reviewing and instructing on Wagg motions, including complex or sensitive files
  • Providing affidavit evidence relating to Wagg processes for use in contested motions and submitting to crossexamination as required
  • Working cooperatively with the Ministry's FOI office, the division's Assistant Deputy Attorney General Office, Regional and local Crown offices and other MAG Divisions to respond to requests and to establish best practices, including updating the Wagg unit's best practices manual
  • Providing advice/instructions to the Ministry's FOI office on FOI requests and alleged privacy breaches
  • Formulating comprehensive written submissions to the Information and Privacy Commissioner on FOI appeals
  • Providing education and training to counsel, law clerks and staff in the Wagg & FOI unit and/or outside stakeholders
  • Providing input on policy decisions impacting the work of the unit

How do I qualify?:


Mandatory:


  • Membership in good standing as a lawyer with the Law Society of Ontario

Knowledge and Skills:


  • Familiarity with Crown briefs and practices, including disclosure and redaction policies and practices
  • Knowledge of FIPPA legislation, including exemptions, fee requests, timelines, mediation and appeals.
  • Familiarity with the processes and interpretation provided by the Independent Privacy Commissioner, Adjudicators, the Divisional Court, Supreme Court and and civil case law an asset.
  • Familiarity with a wide range of government records, including briefing notes, committee reports, Commissions, prosecutorial and investigative briefs, reports, statistics, and new legislation
  • Knowledge and understanding of government and Ministry policies, including the Crown Policy Manual
  • Excellent oral and written communication skills, organizational skills, strong interpersonal skills, proven judgment, innovative analytical and problemsolving skills
  • Experience working with justice sector partners and other community interests in the justice field
  • Ability to work both independently and collaboratively
  • Experience in drafting written submissions and briefing notes
  • Ability to manage a demanding caseload and respond effectively to unexpected situations or matters of urgency and a demonstrated ability to meet tight deadlines
  • Computer literacy is essential, and familiarity with Adobe (particularly Redactions), SCOPE, and the Digital Disclosure Hub
