This position is limited to NAIT internal staff only.


Reporting to the Vice President Administration and Chief Financial Officer, NAIT's General Counsel provides legal advice to the Executive team, senior level management, Board members, other Institute officials and any faculty or staff member acting on behalf of the Institute.

General Counsel oversees all legal matters of transactional and regulatory matters related to the Institute and issues of institutional governance or procedure.


Key Responsibilities:


  • Provision of legal advice related to legislative compliance, including federal, provincial and municipal or regulatory, including but not restricted to privacy laws, employment laws, human rights legislation, copyright legislation, occupational health and safety, and other legislation affecting the operation of a postsecondary educational institution.
  • Provision of legal advice concerning NAIT's RFP processes; collaborations with other postsecondary institutions, government bodies, business entities, nonprofit organizations, healthcare, and industry partners; and capital projects involving acquisition of, sale of, or leasing of lands and buildings and construction projects.
  • Negotiation, creation and review of contracts and other legal agreements such as licenses, agreements, endowments, grants/ funding arrangements, leases etc.
  • Serving in the capacity as the Freedom of Information and Protection of Privacy (FOIP) Coordinator overseeing requests for access to documents and responding to complaints regarding privacy issues and inquiries or investigations by the Privacy Commissioner's office.
  • Provision of legal advice and opinions in monitoring and resolving disputes that may lead to litigation.
  • Responding to complaints or formal inquiries involving outside agencies including the Office of the Information and Privacy Commissioner, the Human Rights Commission, and the Public Interest Commissioner.
  • Provision of advice in legal issues related to governance, development and interpretation of policies, guidelines and procedures.
  • Acting as liaison with external legal advisors.
  • General enterprise risk activities.

Knowledge, Skills & Abilities:


This position requires the incumbent to have extensive familiarity with related legislation including but not limited to the Post-secondary Learning Act, Freedom of Information and Protection of Privacy Act, Health Information Act, Copyright Act, Alberta Human Rights Act, and Public Interest Disclosure Act.

Significant knowledge of the legislative compliance program; conflict of interest guidelines; safe disclosure guidelines and procedures; contract for services guidelines and processes; insurance guidelines and processes; copyright guidelines and procedures; intellectual property guidelines and procedures; and respectful workplace policies and procedures are required.

Well-developed communication and interpersonal skills are essential for this role.


Qualifications:


  • Degree in law (LLB or J.D) required.
  • Minimum 7 years related experience required.

Remuneration:
Commensurate with education and experience.
