PROJECT OVERVIEW:


Bechtel is seeking an experienced Commercial Lead for a large and complex rail system project in the Greater Toronto Area, Ontario, Canada.

This position will become part of a team serving as the primary source of sound professional oversight of project delivery, the client's compliance with regulatory and stakeholder requirements, procurement, risk management and construction expertise and judgement in all phases of the Project works.

***: Provide detailed input on large and complex contract bidding of varied contracting models with the goal of a commercially successful project outcome. Oversee a team performing the review of the progress of numerous contractors and provide executive level management with information regarding any financial, legal, or technical difficulties. Establishment and assurance of compliance with change and amendment procedures in accordance with local public procurement requirements. Establishing and implementing high level claims mitigation and resolution strategies.

RESPONSIBILITIES:
  • Definition of contracting strategy and required staffing.
  • Development and management of appropriate mechanisms to monitor compliance to agreement terms, company policies and procedures.
  • Lead team(s) to implement the contracting strategy inclusive of systems, procedures, and controls.
  • Analyze contracts and execution plans to highlight areas of commercial risk and to provide mitigation actions.
  • Lead bid efforts by coordinating pricing requirements across functional teams, developing staffing plans, and issuing bid documents.
  • Develop Key Performance Indicators for timely commercial decisions.
  • Enable continuous improvement and utilization of best practices.
  • Audit project work areas to identify commercial improvement opportunities.
  • Standup and maintain a robust claims identification, mitigation, and resolution program.

QUALIFICATIONS AND SKILLS:


BASIC QUALIFICATIONS:


Level One:


  • Bachelor's degree in Business, Supply Chain Management, Engineering, or other industry related field along with 15+ years of experience. Postgraduate degree preferred.
  • 10+ years' experience with tendering and execution phase management of complex contracting strategies such as P3, PDB, and CM
  • Specialized courses or experience in pricing, contract law, negotiations, and accounting.

Level Two:


  • Bachelor's degree in Business, Supply Chain Management, Engineering, or other industry related field along with 17+ years of experience. Postgraduate degree preferred.
  • 10+ years' experience with tendering and execution phase management of complex contracting strategies such as P3, PDB, and CM
  • Specialized courses or experience in pricing, contract law, negotiations, and accounting.

ADDITIONAL QUALIFICATIONS:


  • Extensive knowledge of engineering/construction industry contracting best practices, policies, and procedures as well as ability to stay up to date on industry wide trends.
  • Demonstrated oral and written and exemplary interpersonal communication skills as well as ability to develop staffing plans, make hiring decisions, and manage a team of contracts professionals.
  • Experience in recommending, supporting, and leading both traditional and alternative dispute resolution processes and arbitration proceedings.
  • Ability to setup and oversee contract administration and document management systems such as Primavera Unifier, CM14, Aconex, or similar.
  • Experience in mitigating and managing claims for delay, productivity, acceleration, and EOT on large and complex projects.
