The Information and Privacy Commissioner of Ontario is an administrative tribunal responsible for the Freedom of Information and Protection of Privacy Act (FIPPA), the Municipal Freedom of Information and Protection of Privacy Act (MFIPPA), the Personal Health Information Protection Act (PHIPA) and Part X of the Child, Youth and Family Services Act (CYFSA).

Under these acts, the Information and Privacy Commissioner, Tribunal and Dispute Resolution Division:

resolves access to information appeals and complaints when government, health care practitioners/organizations and service providers refuse to grant requests for access or correction; and investigates complaints with respect to the privacy of personal information and personal health information held by government, service providers and health care practitioners/ organizations.


What can I expect to do in this role?:

As a Mediator/Investigator, you will:

  • Investigate privacy complaints made by members of the public under FIPPA, MFIPPA, PHIPA and CYFSA.
  • Attempt to effect settlement of complaints made by members of the public under the FIPPA,
  • MFIPPA, PHIPA and CYFSA.
  • Issue Mediator's Reports/Investigation Reports/PHIPA and CYFSA Decisions summarizing the outcome of the mediation/investigation.
  • Investigate and review certain complaints and selfreported health breach files in accordance with delegated decisionmaking authority, as assigned.
  • Improve customer service through participation in institution relations and appellant relations programs; and
  • Mediate and investigate complaints by:
  • Interpreting a broad range of legislation administered by provincial and municipal institutions to analyze, explain and determine interface, relationships and applicability to access and correction rights;
  • Explain the operation of FIPPA, MFIPPA, PHIPA and CYFSA to complainants, and the purpose and process of mediation and investigation;
  • Investigate the circumstances and gather facts surrounding complaints and selfreported health breaches;
  • Attempt to resolve complaints through mediation, by ascertaining positions of the parties, investigating means of settlement, and determining mediation strategies/approaches;
  • Where possible, provide parties with advisory opinions on the likely outcome of the complaint; and,
  • Complete all required documentation to process or close files.
  • Act as a delegated decision maker under FIPPA, MFIPPA, PHIPA and CYFSA by:
  • Preparing documentation soliciting written representations from the parties, analyzing past precedents, and issuing written decisions/reports with reasons.

How do I qualify?:


You will qualify for this position by demonstrating:

Knowledge:

  • Postsecondary education in a related field, or an equivalent combination of education and experience.
  • Proven investigation and mediation skills, including addressing cybersecurity incidents and privacy matters involving government institutions, health information custodians, and service providers.
  • Understanding of administrative law concepts.
  • Understanding of the provisions and the operation of FIPPA, MFIPPA, PHIPA, and CYFSA.
  • Proven mediation skills and a strong customer service and resolutionoriented approach to conflict situations.
  • A thorough understanding of computer technology and cybersecurity principles.

Interpersonal and Relationship Management Skills:

  • Ability to establish effective working relationships with employees, management and with both internal and external clients.
  • Ability to work both independently as well as act as an effective team member.

Analytical, Research and Project Management Experience:

  • Well-developed analytical/problem solving skills.
  • Ability to plan and conduct extensive research and prepare written reports, evaluations and recommendations.
  • You can identify risks and barriers to mediation decisions.

Communication and Presentation Skills:

  • You have welldeveloped oral communication skills to respond to issues and provide recommendations.
  • You have strong written communication skills to prepare reports and promote initiatives to internal and external stakeholders.

Preferred Asset Qualifications:

  • You have the ability to communicate (orally and in writing) in French.
