***The Contracts Manager is responsible for overseeing the Contracts Department, including a team of Contracts Specialists who manage the overall lifecycle and maintenance of customer contracts and pricing including resolving billing discrepancies, the preparation and completion of all RFX contract tenders including RFPs, RFQs, proposals and pricing agreements, generating reports, and any other assigned activity related thereto. Under the supervision of the Director, Legal & Compliance, and working with the various internal departments and external parties, the Contracts Manager manages the Contracts Department to ensure the efficient operations of the department, including accurate maintenance of all contracts and associated pricing, and the completion and successful submission of responses to all RFX processes.


PRINCIPAL ACCOUNTABILITIES

  • Act as the primary point of contact between the Contracts department and the Company's business units with respect to all tendering activity
  • Act as the primary point of contact between the Contracts department and external customers
  • Assigns responsibility for RFX tasks to team members (e.g. Contracts Specialists), and handles RFX tasks when required.
  • Ensures all customer contracts, including pricing agreements, are properly approved and executed in accordance with company policies
  • Reviews RFX submissions and materials for accuracy, relevance, completeness, and consistency
  • Analyzes and interprets complex legal contract terms, and seeks guidance from Legal when required
  • Ensures that all RFX contract tenders including RFPs, RFQs, proposals and pricing agreements, RFP kick off meeting materials, etc., are completed fully and correctly, in a timely manner

  • Ensures that the department maintains, improves, and prepares on demand various reports and tracking documents used for analysis and record keeping
  • Manages communication with distributors to ensure accurate contract processing and coordinates contract changes
  • Ensures that billing/pricing discrepancies are resolved in a timely manner
  • Coordinates with the Customer Service function to provide timely and accurate contract and pricing information
  • Updates external and internal stakeholders with volume changes/product additions or deletions
  • Analyzes all contract awards and tenders in order to assess win/loss rates and prepare reports to assist with maintaining adequate inventory levels and proper stock allocation to meet demands without incurring high costs and costly writeoffs
  • Maintains a contract hierarchy database
  • Maintains a customer buying group list
  • Coordinates the provision of product samples as part of an RFX process
  • Maintains the company price list in SAP with revisions to pricing, additions or deletions
  • Collectively combines new product information from various tenders for market analysis
  • Ensures that the department monitors tender websites daily for market opportunities
  • Develops and distributes a monthly contract expiry report for management
  • Ensures pricing approvals are obtained and documented in the Business Agreement Recommendation (BAR) form
  • Works as part of a crossfunctional team interacting collaboratively with various internal departments and divisions
  • Supports the company sales representatives and customers to ensure that all internal and external inquiries/concerns are dealt with in a timely and professional manner
  • Identifying Fresenius Kabi's business requirements regarding contract terms and conditions for RFXs activities; planning and leading the negotiation of contract amendments/renewals; and emphasizing contract obligation management for award implementation.
  • Contribute to team specific risk mitigation: responsible for ongoing monitoring and mitigation of risks in specific contracting area of obligation management
